James Lloyd successfully defends midwife in five-week NMC fitness to practise proceedings   – Mountford Chambers – London Barristers Chambers

Mountford’s James Lloyd represented Midwife B, one of three midwives tried together before the NMC’s fitness to practise committee.

The case arose from concerns that the three midwives had seriously mistreated a patient in established labour, including concerns that they had dragged the patient and caused injury, then restrained the patient and conducted a non-consensual intimate examination. The alleged incidents, reported days later in June 2019, were said to have been witnessed by a trainee midwife, who gave evidence of the same.

Midwife B was accused of actions which caused physical injury to a patient, including poor manual handling and the use of unnecessary force, along with restraining the patient during the forced intimate examination.

The case involved extensive cross-examination of witnesses and detailed consideration of medical notes and the impact of Entonox consumption on perception and memory.

Following a five-week hearing which concluded on 27 June 2024, all allegations against Midwife B were dismissed, with none of the NMC’s pleaded facts found proved.
